Family First Leads complies with the federal CAN-SPAM Act of 2003, 15 U.S.C. §§ 7701–7713, and 16 C.F.R. Part 316 in the transmission of all commercial electronic mail messages. This policy describes the controls we apply to every email we send and that our marketing partners must follow when emailing leads sourced from us.
1. Header and Routing Information
We do not use false or misleading header information. The "From," "To," "Reply-To," and routing information — including the originating domain name and email address — accurately identify Family First Leads or the on-behalf-of sender.
2. Subject Lines
Subject lines accurately reflect the content of the message and are never deceptive.
3. Identification as an Advertisement
Commercial messages are clearly and conspicuously identified as advertisements unless the recipient has given prior express affirmative consent to receive the message.
4. Physical Postal Address
Every commercial email we send includes a valid physical postal address for Family First Leads.
5. Opt-Out Mechanism
- Every commercial email contains a clear and conspicuous unsubscribe link.
- Opt-out requests are honored within ten (10) business days, as required by 16 C.F.R. § 316.5.
- The opt-out mechanism is functional for at least thirty (30) days after the message is sent and requires no fee, no information beyond email address and opt-out preferences, and no step beyond visiting a single web page.
- Once an email address has opted out, we will not sell, lease, exchange, or otherwise transfer that address, except to a vendor we use solely to suppress future mailings.
6. Monitoring of Third Parties
Family First Leads monitors marketing partners and affiliates who send commercial email on our behalf or that reference our offers. Partners are contractually required to comply with the CAN-SPAM Act and our acceptable use rules. Violations may result in suspension and indemnification claims under the Terms of Service.
7. Transactional Messages
Transactional or relationship messages (e.g., order confirmations, lead-delivery receipts, password resets) are not commercial messages under CAN-SPAM but still use accurate headers and identifying information.
8. State-Law Compliance
We also comply with applicable state laws governing commercial email, including the California Business and Professions Code §§ 17529 et seq.
