Family First Leads operates lead-generation websites and forms that connect consumers with licensed insurance agents and agencies. This disclosure explains the express written consent we obtain under the Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. § 227 and 47 C.F.R. § 64.1200, and related state telemarketing laws.
1. Express Written Consent Language
When a consumer submits a form on one of our websites, the following disclosure is displayed immediately above the submit button, with the call-to-action button reading "Get My Quote" (or substantively similar):
By clicking "Get My Quote," I provide my prior express written consent to be contacted by Family First Leads and up to five (5) of its marketing partners (a current list of which is available here) at the telephone number and email address I provided, including by autodialer, artificial or pre-recorded voice, SMS/MMS text message, and ringless voicemail, regarding insurance products and quotes, even if my number is on a federal or state Do-Not-Call list. I understand that my consent is not a condition of any purchase, that message and data rates may apply, and that I may revoke consent at any time by replying STOP, by asking the caller to remove me, or by emailing privacy@familyfirstleads.com. I also agree to the Privacy Policy and Terms of Service.
The disclosure is unchecked by default, in clear and conspicuous font, and the submit action constitutes the consumer's electronic signature under the E-SIGN Act.
2. Proof of Consent: TrustedForm & Jornaya Certificates
Every lead we sell is captured with at least one third-party consent certificate so the buying agent has independent, neutral proof of TCPA-qualifying consent:
- TrustedForm (ActiveProspect): a Certificate URL is generated for every form submission, capturing a tamper-evident replay of the consumer's session, the disclosure shown, IP address, user agent, page URL, and timestamp.
- Jornaya LeadiD: where deployed, a LeadiD token is created for additional independent verification.
- Certificate retention: we retain certificates for at least five (5) years and pass them with the lead payload via API, webhook, or CRM delivery (field names:
trusted_form_cert_url,jornaya_lead_id). - Claim & store: agents are required to "claim" each TrustedForm certificate within 72 hours of receipt to lock the consent record to their account. We provide automated claiming for agents who supply API credentials.
3. TCPA-Ready Lead Standard
A lead is labeled "TCPA-Ready" when it meets all of the following:
- The consumer affirmatively submitted a form on a Family First Leads-owned or vetted partner site.
- The express written consent language above (or substantively equivalent disclosure) was displayed.
- A valid, claimable TrustedForm certificate (and where available, Jornaya LeadiD) is attached.
- The consumer's IP, user agent, originating URL, and timestamp are recorded.
- The phone number has been validated and screened against known litigator and DNC sources.
4. Marketing Partners
A current list of marketing partners with whom we may share the consumer's information is available at familyfirstleads.com/partners and is updated regularly. The list is also available by emailing partners@familyfirstleads.com.
5. Calling Hours and DNC
We and our agents observe federal calling-time restrictions (8:00 a.m. – 9:00 p.m. local time of the called party) and stricter state rules where applicable. We maintain an internal Do-Not-Call list and honor all revocation requests within a reasonable time, not to exceed ten (10) business days.
6. Revocation of Consent
You may revoke consent at any time and through any reasonable means, including:
- Replying STOP, END, QUIT, CANCEL, UNSUBSCRIBE, or REVOKE to any SMS message.
- Telling any caller to add you to their internal Do-Not-Call list.
- Emailing privacy@familyfirstleads.com with the phone number and email address to remove.
- Calling +1 (855) 555-1234.
Revocation applies to Family First Leads. Marketing Partners are independently required to honor revocations they receive.
7. Agent & Buyer Obligations
By purchasing leads, you represent and warrant that you will:
- Only contact consumers about the insurance products they requested.
- Claim and store the TrustedForm certificate for each lead.
- Observe all federal, state, and local telemarketing and consumer-protection laws, including the TCPA, TSR, state mini-TCPA statutes (e.g., FL FTSA, OK TSA, WA CEMA), and carrier rules.
- Indemnify Family First Leads for any claim arising from your contact with a consumer, as set out in the Terms of Service.
8. Disputes
If you believe you were contacted in violation of the TCPA or any state law, email compliance@familyfirstleads.com with the date, time, phone number called, and a copy of the consent record reference, and we will investigate promptly.
